This agreement gives Global Nerve Foundation (“GNF”) permission to livestream and record your presentation at an GNF program. You retain all copyright and other intellectual property rights to your presentation.  However, if GNF records your presentation at the program, GNF will own the rights to that recording.

Presentation Agreement

Program Name: Multidisciplinary Approach to the Brachial Plexus (the “Program”)

This Presentation Agreement (the "Agreement") confirms the agreement between you, the speaker named above, and Global Nerve Foundation ("GNF" "we," "our," or "us") regarding the Program, the Presentation, and all materials relating to the Presentation, including handouts (collectively, the "Materials").

You and GNF hereby agree as follows:

1. You agree to participate in the online streaming of the Program and consent to GNF live-streaming and/or making photographic, film, audio and/or audio-visual recordings of the Program, your participation in the Program, and/or the Presentation and the Materials, by any GNF employee, contractor, or representative (the "Footage"). You grant to GNF the exclusive right to live­stream or record such Footage. You further consent to GNF use of your name, image, voice, biography, and likeness, including photographs of you in connection with the Footage, in any medium now known or later developed, including for commercial, advertising, educational, and charitable purposes.
2. GNF acknowledges and agrees that, except as provided in this Agreement, you retain all intellectual property rights to the Presentation (including copyrights). You acknowledge and agree that GNF will be the exclusive owner of all rights (including copyrights) to the Footage and that GNF will have the sole and exclusive right throughout the world in all languages and in perpetuity to use (including copying, distributing, and publicly performing) all or any part of the Footage in any format or version, by any means and in any media now known or later developed.
3. You grant GNF an irrevocable, perpetual, non-exclusive, worldwide license to use, reproduce, publish, publicly display and publicly perform the Materials (in whole or in part), in all media now known or later developed, including for commercial, advertising, educational, and charitable purposes.
4. Any significant revisions GNF makes to the Footage or the Materials (that is, any revisions that would materially change the educational or scientific content of the Presentation) must be approved by you before being publicly displayed by GNF. You agree to provide GNF with your approval of, or alternatively any comments on, the requested revisions within ten days after your receipt of our request.
5. You represent and warrant that the content of the Presentation is original to you and not copied from any other party. You further represent and warrant that, except for the excluded items listed on Schedule A to this Agreement, you own all copyrights in and to the Presentation and the Materials or have obtained all permissions, licenses, or other grants of rights needed for you to enter into this Agreement.

6. You agree that the Presentation will comply with all relevant ACCME guidelines relating to faculty disclosure of conflicts of interest and commercial support to ensure fair balance, independence, objectivity, and scientific rigor.
7. You are granting GNF the rights set out in this Agreement in consideration of your participation in the Program and without any remuneration to you, and GNF has no obligation to you hereunder except as expressly set out in paragraph 4 above.
